DOING ALARM BUSINESS IN PENNSYLVANIA?
NEW HOME IMPROVEMENT CONSUMER PROTECTION ACT COULD IMPACT YOU!

Recently Pennsylvania enacted a new Act named the Home Improvement Consumer Protection Act (HICPA), which seems to require alarm dealers to register as “home improvement contractors.”

While the registration process is simple, the impact of the Act itself will create contractual - and other - issues for alarm dealers (such as protections that would allow a consumer to void a contract if it contained a hold harmless provision and or a waiver of trial by jury, among others).  This, of course, can adversely impact all of us.

In essence, PA dealers are looking to get - at a minimum - clarification on whether or not alarm systems and alarm monitoring services are included.  Ultimately, many feel alarm system contractors should not be regulated under this Act (I.e. the business of life safety is not "home improvement").
